Merit should be the criteria used. If we have a rule/law that states how many persons of which sex should be employed by what date to achieve an arbitrary percentage then the "not-so-able" will be promoted/emplyed just to fulfil it. And this way will lead to the wokeism/identity politics/whatnot that the US is now mired in.

Despite years of trying to hire more women engineers, large tech companies in the US tend to have women making up less than 20% of their software engineers. The 40% goal may be too ambitious.
